Terms
  1. To bid on our property, you must be of legal age to enter into contract to purchase real estate (18 in most states, 21 in others). If you're in doubt about the legal age to enter into contract in your state, please consult with competent legal counsel before bidding.
  2. All Real Estate is considered a "cash transaction" and no financing is offered. Payment can be made with Cashier's Check, or Bank Wire Transfer.
  3. While auction is "active", all bids MUST be placed online.  Written offers will not be accepted.
  4. Winning bid is subject to seller approval.
  5. Buyers Agent commission of 2.5% is being offered.
  6. All bids are placed in US Dollars.
  7. If you are outbid by another bidder, you will receive an email notice so you can return and increase your bid if you so desire.
  8. The bidding will be open and everyone will have access to the bid history during the auction.
  9. As the auction nears the ending time it will auto-extend until bidding is silent for 2 minutes.
  10. If there is more than one high bid at the same level (a tying bid), the bid first submitted will be honored.
  11. The high bidder will be notified via email after the auction ends.
  12. Seller reserves the right to postpone or cancel this auction at any time for any reason.
  13. Sale is “as-is”, "where-is". Seller will not fix anything.
  14. BUYERS PREMIUM:
    A Five Percent (5%) Non Refundable Buyers Premium is in effect.(Percentage is calculated on, and added to
    the Winning Bid Price, which together equals the Total Sales Price.)
  15. Within 24 Hours of auction closing, buyer is required to deposit 5% of the purchase price via cashiers check or bank wire..
  16. Winning Bidder has 10 calendar days to pay the remaining 10% balance via cashier's check or bank wire. If all
    funds to complete the Total Sales Price are not received by seller within the time frame specified, Seller will declare the Bidder to be in
    default. In the event of such declaration, the Winning Bidder's bid shall be null and void and the Seller shall have no further
    liability or obligation whatsoever to that Bidder. Bidder will forfeit the Property, Buyers Premium, and Down Payment. Additionally,
    The Seller reserves the right to immediately, and without further notice, put the Property back up for Auction or sale.
    IF YOU DID NOT DO YOUR DUE DILIGENCE AND ARE NOT PREPARED TO PAY WITHIN THE ALLOTTED 10 DAYS, PLEASE DO NOT BID!
  17. INSPECTION:
    No Bid or Sale is contingent upon the inspection of the property. It is Bidders sole responsibility to request access to
    the property for any inspections. Should Bidder personally inspect, or have a representative inspect any properties offered through
    Seller, its Agents, or Affiliates, Bidder assumes all risks associated with such inspection and agrees to hold Seller, its agents or
    affiliates harmless from any and all claims.
  18. ADDITIONAL REQUIREMENTS:
    Winning Bidders will be required to execute and return within 3 days of receipt, an "As Is Purchase
    and Sale Agreement" for the Total Sales Price that has additional terms, conditions, and disclosures relating to the real estate
    purchase as well as sign paperwork with the Closing Agent/Title Company to complete the transaction and properly convey title to
    Bidder(s). Bidders that have not signed and returned our Terms & Conditions may be subject to being "bumped" by Bidders that have
    previously returned Signed Terms and Conditions.
  19. CLOSING:
    After executing the "As Is Purchase and Sale Agreement" and purchase documentation, Winning Bidder(s) will be
    contacted by a Closing Agent/Title Company who will facilitate the closing process with Winning Bidder(s). Winning Bidders are
    responsible for all closing costs and fees, including, but not limited to, recording fees, title insurance, closing fees, documentary
    transfer taxes (or other taxes), pro-rations, and if applicable, any Association Fees.
  20. Once 5% premium is collected, the buyer has 10 calander days to perform their due diligence. Purchase of the property is considered an as is transaction, so ONLY rely and bid after your own due diligence.  Once the 10 day due diligence expires, the 10% earnest funds are non refundable.
  21. Closing will take place at seller's or buyers title company within 5 days of due diligence period.
  22. Winning bidder may, at their option and expense order a title examination and insurance.
Buyer Premium: 5.0%
This fee is added to the winning bid amount and is paid by the Buyer. High Bid + Buyer Premium = Selling Price.
