Question: If a person bids say $49,000 And it's the final bid can the owner turn it dowN or is it final?
Answer: A bid in a reserve auction does not obligate the seller to sell the property to the bidder unless the bid is in excess of the reserve price set by the seller prior to the auction. When a bid is made that exceeds the reserve price ammount, then the auction becomes an absolute auction. In such a situation, the seller is obligated to sell the property to the high bidder at the end of the auction under the terms and conditions of the auction.

Terms

Granger, Thagard & Associates, Inc.: ON-LINE BIDDING TERMS BIDDER VERIFICATION:
 
To bid on an offered property, all bidders must be of legal age to enter into contract to purchase real estate. The identity of All Bidders will be verified, bidding rights are provisional, and if complete verification is not possible, Granger, Thagard & Associates, Inc. will reject the registration and their bidding will be terminated. 

BIDDING PROCESS: The auction is a timed event with the end date/time posted. The bidding will be open and everyone will have access to the bid history during the auction. If a bidder is out bid by another bidder, the bidder who is out bid will receive an email notification to allow them to increase their bid as they so desire. As the auction nears the ending time, it will auto-extend until bidding is silent for 2 minutes. The auto-extend feature will remain in effect until no further bids are received within the 2 minute time frame. If there is more than one high bid at the same level (a tying bid), the bid first submitted will be honored. The high bidder will be notified by email after the end of the auction. Written offers may be submitted for consideration. 

BUYER’S PREMIUM: All bids are placed in US Dollars. The winning bid will be subject to a 10% Buyer’s Premium that will be added to the High Bid resulting in the Contract Sales Price. AS-IS: This property will be sold in As-Is, Where-Is condition. The high bidder/purchaser acknowledges that he/she is accepting the property in its’ As-Is, Where-Is condition, relying only on his or her own judgment. 

TITLE: Title will be conveyed to the Purchaser by Statutory Warranty Deed, subject to ad valorem taxes, rights of redemption, recorded or unrecorded easements, rights of way, restrictions, government zoning regulations/ordinances. It will be the responsibility of the high bidder/ purchaser to purchase title insurance if desired. SALES 

CONTRACT: The property is being sold under the specific terms as stated in the sales contract. Please read and review the contract prior to bidding. Immediately upon completion of the auction, the successful high bidder/purchaser must execute a completed sales contract along with down payment. A copy of the contract is available for inspection prior to the auction. 

PAYMENT: The successful high bidder/purchaser will deposit a Non-Refundable down payment equal to 10% of the purchase price the day of the sale. The balance will be due on or before 30 days from the auction date. The deposit will be held in the Trust Account for Granger, Thagard & Associates, Inc. 

CLOSING COSTS: All closing costs will be paid by the purchaser. 

TAXES: Ad Valorem Taxes will be pro-rated at closing. 

LEAD PAINT: If this property is a residence built prior to 1978 it may contain lead based paint. Any lead paint inspections are to be completed 10 days prior to the auction ending date. The seller has no knowledge of the presence of lead paint.
