Question: Hi, If I win the bid, do I have to submit purchase agreement with all the terms, or is there a pre-defined purchase agreement template?
Answer: Hi, there will be a pre-defined purchase agreement. There is a SAMPLE Purchase Agreement that was just uploaded to the Auction Listing under the 'FILES' Section.
Question: Is there a special page for the auction, or will one pop up for this particular property when the auction begins tomorrow? Also, can you join the auction at anytime prior to close?
Answer: This is the page you'll bid on, and yes you can register to bid any time prior to close.
Question: Good afternoon Mr. Russo, It was a pleasure speaking with you the other day. I did have one final question regarding the auction. Do you know if the property has a clear title? If I win the bid, I would certainly have a title search and insurance done, but figured it was worth seeing if you already knew the answer. Lastly, I have purchased properties at auction in other states, and if for some reason the title does not come back clear, that was reason to cancel the purchase. Is this the case here, and if the title was not clear, would I receive my earnest money back. Thank you in advance for your time, Bryan Fong
Answer: Hi, to my understanding the title should be clean. If there does end up being any issues with title, we will remedy before we close.

Terms
  1. BUYER'S PREMIUM: 3%
    This fee is added to the winning bid amount and is paid by the Buyer. High Bid + Buyer Premium = Selling Price.
  2. To bid on our property, you must be of legal age to enter into contract to purchase real estate (18 in most states, 21 in others). If you're in doubt about the legal age to enter into contract in your state, please consult with competent legal counsel before bidding.
  3. While auction is "active", all bids MUST be placed online.  Written offers will not be accepted.
  4. Winning bid is subject to seller approval.
  5. Buyers Agent commission of 3% is being offered.
  6. All bids are placed in US Dollars.
  7. If you are outbid by another bidder, you will receive an email notice so you can return and increase your bid if you so desire.
  8. The bidding will be open and everyone will have access to the bid history during the auction.
  9. As the auction nears the ending time it will auto-extend until bidding is silent for 2 minutes.
  10. If there is more than one high bid at the same level (a tying bid), the bid first submitted will be honored.
  11. The high bidder will be notified via email after the auction ends.
  12. Seller reserves the right to postpone or cancel this auction at any time for any reason.
  13. Sale is “as-is”, "where-is". Seller will not fix anything.
  14. Buyer WAIVES inspections and relies upon the condition of the Property based upon Buyer's own examination prior to the start of the auction.
  15. Within 18 hours of auction close, winning bidder will be asked to obtain loan pre-approval or show proof of funds and sign a sales contract at the winning bid amount and based on the terms described here.
  16. Closing will take place at seller's chosen title company within 30 days of signing the contract.
  17. When contract is signed, winning bidder will pay $1,000 earnest money to be held by the listing brokerage.
  18. To place a bid on this auction, you MUST provide a valid credit card which will be Pre-Authorized (not charged) in the amount of $500.  If the winning bidder fails to sign the sales contract and submit the required earnest money deposit within 18 hours of auction close, they will be charged a $500 non-refundable default fee.
  19. Winning bidder may, at their option and expense order a title examination and insurance.
  20. Seller will include the following personal property in the sale: None
  21. Seller will exclude the following real property from the sale: None
Buyer Premium: 3.0%
